Amgen Subsidiary Ordered to Pay $20.2 Million in Antibody Patent Case — A Clear Example of IP Monetization Through Enforcement

A U.S. federal jury in Delaware found that Teneobio, a subsidiary of Amgen, must pay Harbour Antibodies $20.2 million in damages for infringing a patent related to antibody technology used in biologic drugs. According to a report by Sahm Capital (via Reuters), the jury agreed that Teneobio’s “UniRat” platform violated Harbour’s patent rights covering technology for producing antibodies using genetically engineered rats. Amgen acquired Teneobio for $900 million in 2021 to bolster its biologics business, the same year Harbour Antibodies originally filed the lawsuit to protect its antibody discovery platform. Harbour BioMed stated that the Delaware jury not only found the patent valid but also found willful infringement, awarding the full requested damages amount of $20,203,704. The case is significant because it highlights how intellectual property functions not just as a defensive asset, but as a critical tool for recovering R&D investment and generating business value. In the biopharmaceutical sector, platform technologies for antibody discovery dictate a company’s competitive edge. This verdict demonstrates to biotech startups how patents covering foundational technologies can drive monetization through strategic enforcement, damages claims, and future licensing leverage. Harbour BioMed noted that the finding of willful infringement may allow it to ask the court for up to treble damages, potentially raising the award to as much as $60.6 million. The company also indicated plans to continue enforcing its broade
